Apps Alliance President Jon Potter today testified before a U.S. House of Representatives Energy and Commerce subcommittee about proposed legislation to protect innovators from patent trolls’ abusive demand letters.
Potter advised the subcommittee that draft legislation should go further to end abusive demand letters.
“The hardest challenge for the subcommittee may be to require good faith and fair dealing by extortionist patent trolls without upsetting legitimate enforcement practices of great American innovators. The discussion draft makes progress toward threading that needle, but it does not yet effectively protect startups and Main Street businesses from the trolls I have described. Fortunately, the discussion draft does not harm legitimate enforcement practices; and it can be improved to strengthen protection against trolls without undermining legitimate patent owners’ interests,” Potter said.
